These Terms of Service (“Terms”) constitute a binding agreement between Anasuya (“Anasuya”, “we”, “us” or “our”) and you (“you” or “your”) and govern your access to and use of our website, online store, products and related services (collectively, the “Services”).

By accessing our website, creating an account, placing an order, purchasing a product or otherwise using our Services, you acknowledge that you have read, understood and agreed to these Terms and our Privacy Policy and other policies published on our website.

If you do not agree with these Terms, please do not use the website or place an order.

Anasuya reserves the right to update or modify these Terms from time to time. The updated version will be published on the website and will apply to orders and website use after the applicable effective date.

1. Eligibility and Account Information

You agree to provide true, accurate and complete information when placing an order or otherwise interacting with Anasuya. You are responsible for ensuring that your name, address, PIN code, phone number, email address, size, customisation details and other information provided to us are correct.

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for activities carried out through your account.

Anasuya may suspend or restrict access to an account where there is reasonable evidence of misuse, fraudulent activity, abuse of our policies or violation of these Terms.

2. Products and Product Information

We make reasonable efforts to ensure that product descriptions, images, colours, measurements, prices and other information displayed on our website are accurate.

However, actual colours may vary depending on your device, screen settings, lighting and other factors. Printed, handmade or artisanal products may also have minor variations in colour, texture, placement or finish.

Such minor variations that do not materially affect the product will not ordinarily constitute a defect.

Product availability is subject to change without notice.

Anasuya reserves the right to correct typographical, pricing, product-description or other errors and to update product information at any time.

3. Customised, Personalised and Printed Products

Anasuya offers customised, personalised and printed products. Such products may be produced specifically for an individual customer and therefore may be subject to special terms.

Once printing, production or customisation has commenced, an order may not be cancellable or refundable except where required under applicable law or where the product is defective, damaged, incorrectly produced or materially different from the approved order.

Where you provide names, text, photographs, artwork, logos, images, colours, measurements, design instructions or any other information for customisation, you are responsible for ensuring that the information is accurate and suitable for production.

Anasuya will not ordinarily be responsible for errors arising from incorrect information, spelling, names, images, sizes, colours or other specifications supplied by you.

Where Anasuya provides a design preview, proof or mock-up for approval, you are responsible for carefully reviewing it before providing approval. Once approval is provided and production commences, changes may not be possible.

4. Customer-Supplied Content and Intellectual Property

If you upload, submit or provide any photograph, artwork, logo, design, text or other content (“Customer Content”) for use in creating your customised product, you represent that you have the necessary rights, permissions and authority to provide that content and to authorise Anasuya to use it for fulfilling your order.

You must not provide Customer Content that infringes any copyright, trademark, design right, privacy right, publicity right or other legal right of another person or entity, or that is unlawful or prohibited by applicable law.

You remain responsible for Customer Content supplied by you. Anasuya does not assume responsibility for determining whether Customer Content submitted by you is legally authorised for use.

You grant Anasuya a limited, non-exclusive right to use, reproduce, process and transmit Customer Content solely to the extent reasonably necessary to manufacture, customise, fulfil and deliver your order.

Anasuya may refuse to produce any customised item where the requested content appears unlawful, infringing, abusive, defamatory, hateful, obscene or otherwise inappropriate or creates a material legal or operational risk.

5. Ownership of Anasuya Content

All website content, including photographs, artwork, illustrations, graphics, logos, product designs, text, layouts, branding, videos, software and other materials created or provided by Anasuya (“Anasuya Content”), is owned by or licensed to Anasuya and is protected by applicable intellectual-property laws.

You may use the website and Anasuya Content only for personal, non-commercial purposes in connection with purchasing or using our products.

You may not copy, reproduce, modify, distribute, publish, sell, license, reverse engineer or commercially exploit Anasuya Content without our prior written permission.

6. Orders and Contract Formation

Placing an order on our website constitutes an offer by you to purchase the selected product(s) on the applicable terms.

An order is subject to acceptance and availability. An order confirmation or payment acknowledgement does not necessarily mean that Anasuya has accepted the order if there is an issue with availability, pricing, payment, customisation, fraud screening or other material issue.

We reserve the right to refuse, cancel or limit an order where reasonably necessary, including where there is a pricing error, suspected fraudulent activity, stock or production limitation, incorrect product information, or an inability to fulfil the order.

Where Anasuya cancels a prepaid order, any eligible refund will be processed in accordance with the applicable refund policy and payment method.

7. Prices, Payments and Taxes

Prices displayed on the website are the prices applicable at the time of purchase, unless otherwise stated.

You agree to pay all amounts applicable to your order, including product price, shipping charges, applicable taxes, customisation charges and other charges displayed at checkout.

Anasuya may change prices, offers and promotional terms at any time. Changes will not ordinarily affect an order that has already been accepted, except where correction is required due to an obvious error or where otherwise permitted by law.

8. Shipping and Delivery

Orders will be shipped to the address provided by you at checkout. Delivery timelines are estimates and may vary depending on production requirements, courier operations, location, weather, public holidays and other factors.

Anasuya is not responsible for delays caused by courier partners, force majeure events, incorrect customer information, unavailable recipients or other circumstances outside our reasonable control.

You are responsible for providing a complete and accurate delivery address, PIN code and contact details.

Additional shipping or re-delivery charges may apply where delivery fails because of incorrect or incomplete information, recipient unavailability, refusal to accept delivery or other circumstances attributable to the customer.

9. Returns, Exchanges and Refunds

Returns, exchanges, replacements and refunds are governed by Anasuya’s separate Returns, Exchange, Refund & Cancellation Policy, which forms part of these Terms.

By placing an order, you acknowledge that you have reviewed and agreed to that policy.

In particular, customised, personalised and printed products may have restricted cancellation, return and refund eligibility once production or printing has commenced, subject to applicable law.

10. Order Cancellation

Cancellation requests must be made as soon as possible after placing an order.

Cancellation may not be possible once an order has entered processing, printing, production, customisation, packing or dispatch.

For customised, personalised and printed products, cancellation may not be possible once production or printing has commenced.

Any eligible refund will be handled in accordance with the applicable Refund Policy.

11. Website Use

You agree to use the website only for lawful purposes and in accordance with these Terms.

You must not:

Use the website for fraudulent, unlawful or unauthorised purposes.

Attempt to gain unauthorised access to our website, systems, accounts or databases.

Interfere with the security, operation or availability of the website.

Introduce viruses, malware or other harmful code.

Use automated systems to scrape, copy or systematically extract website content without our written permission.

Impersonate another person or provide false information.

Use our website or content to infringe the rights of another person or entity.

Anasuya may restrict or terminate access to the website where there is a violation of these Terms or conduct that may harm Anasuya, its customers or its systems.

12. Promotions, Discounts and Offers

Promotional offers, discounts, coupon codes and other campaigns may be subject to additional terms communicated at the time of the offer.

Unless expressly stated otherwise, promotional offers cannot be combined, transferred, exchanged for cash or applied retrospectively to previous orders.

Anasuya reserves the right to withdraw, modify or cancel a promotion where necessary, including in cases of misuse, technical error or suspected fraudulent activity.

13. Third-Party Services and Links

Our website may contain links to third-party websites, payment providers, logistics providers, social-media platforms or other services.

Third-party services are governed by their own terms and policies. Anasuya is not responsible for the content, availability, security, policies or practices of third-party websites or services, except to the extent required by applicable law.

14. Reviews and Customer Feedback

If you submit a review, testimonial, photograph, comment, suggestion or other feedback to Anasuya, you grant us permission to use it for legitimate business, marketing and promotional purposes, subject to applicable law and our Privacy Policy.

You should not submit confidential information or content that you do not have the right to share.

Anasuya may remove or decline to publish content that is unlawful, misleading, abusive, defamatory, irrelevant or otherwise inappropriate.

15. Privacy

Your use of the website is also subject to Anasuya’s Privacy Policy. By using our website or placing an order, you acknowledge that your information may be collected, used and processed as described in that policy.

16. Disclaimer

To the extent permitted by applicable law, the website and its content are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted, error-free, secure or available at all times.

We make reasonable efforts to provide accurate product information but do not warrant that every website description, image, colour representation or other information will always be complete or free from error.

Nothing in these Terms excludes or limits any warranty, guarantee, consumer right or remedy that cannot lawfully be excluded or limited under applicable law.

17. Limitation of Liability

To the maximum extent permitted by applicable law, Anasuya shall not be liable for indirect, incidental, special or consequential losses arising from the use of the website or products, except where such liability cannot lawfully be excluded.

Nothing in these Terms limits liability for matters that cannot legally be limited or excluded under applicable law.

18. Indemnity

To the extent permitted by applicable law, you agree to indemnify and hold Anasuya harmless from claims, losses, liabilities, damages and reasonable expenses arising from your unlawful use of the website, breach of these Terms, or Customer Content supplied by you that infringes the rights of another person or entity.

19. Force Majeure

Anasuya will not be responsible for failure or delay in performing an obligation where the failure or delay results from circumstances beyond our reasonable control, including natural disasters, severe weather, fire, flood, epidemic or pandemic-related disruption, war, civil unrest, strikes, government action, transport disruption, internet or infrastructure failures, courier disruption or other force majeure events.

Where reasonably practicable, Anasuya will take commercially reasonable steps to minimise the impact of such events.

20. Suspension and Termination

We may suspend or terminate access to the website or certain Services where reasonably necessary due to violation of these Terms, suspected fraud or abuse, security concerns, unlawful activity or other conduct that may materially harm Anasuya or its customers.

Termination or suspension will not affect rights and obligations that by their nature are intended to survive termination.

Anasuya may modify, suspend or discontinue any product, feature, website functionality or part of the Services at any time.

Where a material change affects an accepted prepaid order, Anasuya will address the order in accordance with applicable law and the relevant policies.

22. Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of India.

Subject to applicable law, courts having jurisdiction in Delhi shall have jurisdiction over disputes arising out of or in connection with these Terms, the website or an order placed with Anasuya.

23. Consumer Rights

Nothing in these Terms is intended to exclude, restrict or override any mandatory rights or remedies available to consumers under applicable Indian law.

24. Severability

If any provision of these Terms is held to be invalid, unlawful or unenforceable, that provision shall be modified or severed to the minimum extent necessary, and the remaining provisions shall continue to apply to the extent permitted by law.

25. Entire Agreement

These Terms, together with the Privacy Policy, Returns, Exchange, Refund & Cancellation Policy, Shipping Policy and any other policies expressly incorporated into them, constitute the terms governing your use of the Anasuya website and purchase of products.

Where there is a conflict between these Terms and a product-specific or transaction-specific term, the applicable specific term will govern to the extent of the conflict, subject to applicable law.
